Terms of Service
These terms apply when you use the Athlomate app. By creating an account you agree to them. If you do not agree, please do not use the app.
1. What Athlomate is
Athlomate helps people find others to play sport with in the same city and at a similar level. You can create and join games, chat with other players and give feedback after a game. Athlomate does not organise, supervise or insure any game, and it does not book courts or fields. Court information, including whether a court is free or paid, may be wrong. You are responsible for checking availability and for any booking or payment with the venue. It is not a dating app.
2. Who can use it (18+)
You must be 18 years or older. By signing up you confirm that you are. We may close accounts that we believe belong to someone under 18.
3. Your account
- Give accurate information about yourself (name, age, city, sports and skill levels) and keep it up to date.
- One person, one account. Keep your password private. You are responsible for what happens under your account.
- You can delete your account at any time in the app (Settings, Delete account). This is permanent.
4. How to behave: zero tolerance
Athlomate is for friendly, safe sport. We have zero tolerance for abusive content and abusive users. You must not:
- harass, threaten, insult, discriminate against or pressure anyone, or send unwanted sexual content or advances;
- post anything illegal, hateful, violent or sexually explicit, or share someone else's private information or photos without their consent;
- impersonate another person, lie about your age or identity, or create fake or duplicate accounts;
- use the app for spam, advertising, selling, or to recruit for anything other than playing sport;
- try to break, overload or misuse the app or its data, or collect other users' data.
5. Report, block and how we moderate
You can report a user, a message or a game and block a user from the app at any time. A blocked user cannot see you or contact you. Reports are stored together with the information needed to review them.
[REVIEW: new text for the EU Digital Services Act (DSA), drafted for the lawyer to check against Articles 11 to 17 and, if they apply to us, 20 and 23]
- What is not allowed. Everything listed in section 4, and anything else that is illegal.
- How reports are handled. Every report is reviewed by a person, not by software. The only automatic measures in the app are limits against spam (for example a maximum number of messages, games and requests in a given time). We do not use automated tools to decide on removing content or suspending accounts.
- What can happen. Depending on how serious the breach is, we may warn you, remove content (a message, a photo or a game), suspend your account or ban it. A ban also cancels games you host that have not started yet. Where safety requires it, we may act at once.
- Our reasons and how to appeal. If we remove your content or suspend or ban your account, we tell you by email what we did, which rule you broke, the facts our decision is based on, and that a person made the decision. You can appeal by replying to that email within 6 months. A person will look at it again, and we will tell you the result and the reasons.
- Reports without an account. Anyone, with or without an account, can report illegal content by email to [email protected]. Please say what the content is, where you saw it and why you think it is illegal. We confirm that we received it and tell you what we decided.
- Contact point. [email protected] is our single point of contact for users and for authorities. You can write to us in English or Greek.
6. Meeting in person: your own responsibility
Games take place between users, outside the app. We do not check who people are, how good they are or whether a place is safe or suitable. Please take normal care: meet in public places, tell someone where you are going, and play within your abilities. Sport carries a risk of injury; you take part at your own risk. We are not a party to any arrangement between users.
7. Your content
You keep the rights to what you post (profile, photos, messages, game descriptions). You give us a limited licence to store it and show it to other users as the app works, for as long as you keep it in the app. You promise that you have the right to post it and that it respects these terms and the law.
8. Availability and changes to the app
We try to keep the app running but cannot promise it will always be available or error-free. Features may change. Map pictures, address search and court information come from third parties (see the Privacy Policy) and may be incomplete or out of date.
9. Ending your use
You may stop using Athlomate and delete your account at any time. We may suspend or end your access if you break these terms or the law. Sections that by their nature should continue (for example 6 and 10) continue after that.
10. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your rights as a consumer. Otherwise, and as far as the law allows, we are not liable for what other users do or say, for injuries or losses during games, or for indirect losses. [REVIEW: lawyer to confirm the liability wording for a free app operated from Berlin, Germany and offered only to users in Greece]
11. Changes to these terms
We may update these terms, for example when the app changes. For important changes we will tell you in the app. If you keep using the app after a change you accept the new terms; if you do not, you can delete your account.
12. Governing law
These terms are governed by Greek law. If you are a consumer, you also keep the mandatory consumer protection rights of the country where you live. [REVIEW: confirm governing law and courts. Note for the lawyer: the operators live and work in Berlin, Germany, but the app is offered only to people in Greece, so Greek consumer protection rules still apply to users in Greece whatever law is chosen]
13. Who we are and how to reach us
The operator of Athlomate is OPERATOR_NAME, operated from Berlin, Germany, OPERATOR_ADDRESS. [REVIEW: confirm how to describe the operators (two people working together) and their legal form] Contact: [email protected]. More in the Impressum. How we handle your data is explained in the Privacy Policy.
